1. Who We Are

LawBits, LLC ("LawBits") operates a software platform that generates state-specific estate planning documents from templates designed by licensed attorneys. LawBits is a software service. We are not a law firm, and we do not provide legal advice. Your documents are generated based on your answers to our questionnaire and have not been individually reviewed by an attorney for your specific situation. For legal advice or attorney review, you must engage an attorney separately.

FreedomCounsel Legal, LLC ("FreedomCounsel") is a separate law firm and a separate business from LawBits. FreedomCounsel offers limited-scope attorney consultations in the states where its attorneys are licensed. If you choose to consult FreedomCounsel, you enter a separate agreement with FreedomCounsel and pay FreedomCounsel directly. Your purchase of the LawBits service does not include attorney services and does not create any relationship between you and FreedomCounsel.

2. Acceptance of These Terms

By accessing or using our Services, you agree to these Terms and our Privacy Policy. You must be 18 years or older and legally able to enter a contract. By clicking "I Agree," creating an account, making a purchase, or continuing to use our Services, you consent to these Terms electronically.

4. Your Documents

Your documents are generated by LawBits software from templates designed by licensed attorneys, based on your answers to our questionnaire. They are not customized legal work product and have not been reviewed by an attorney for your specific situation. We strongly recommend that you have your documents reviewed by a licensed attorney before signing them. You are responsible for reviewing your documents and ensuring they reflect your intentions before you execute them.

5. Attorney Consultation Is Separate

LawBits does not provide attorney consultations or legal advice. If you would like an attorney to review your documents or answer legal questions, you may engage a licensed attorney of your choosing. LawBits can also refer you to an independent law firm, such as FreedomCounsel Legal, LLC, that offers limited-scope attorney consultations.

LawBits and any law firm it refers you to, including FreedomCounsel, are separate businesses. If you choose to engage a referred firm, you will enter a separate agreement with that firm, sign that firm's engagement agreement (such as a Limited Scope Representation Agreement) before your consultation, and pay that firm directly. LawBits does not collect payment on any referred firm's behalf and does not share in, or receive any portion of, the legal fees you pay. LawBits does not direct or supervise any firm's legal work. Any attorney-client relationship, and any attorney-client privilege, arises solely between you and the firm you engage under that separate agreement.

6. Document Updates

Your plan includes three document updates within one year of your initial document generation. Updates may be used for substantive changes, including changes to beneficiaries, executors, agents, distribution percentages, family additions, or other preferences captured in your questionnaire.

Small corrections made within 14 days of your initial document generation, such as typo fixes, name-spelling corrections, and address corrections, are not counted as updates and remain available at no charge.

Additional updates beyond the three included, and any updates made after the first year following initial document generation, are available at $150 per update.

Updates do not include changes that require switching to a different plan, the addition of new document types, or restructuring that exceeds what your questionnaire accommodates. For changes of that nature, you may need to purchase a different plan or engage an estate planning attorney directly.

All fees for the LawBits software service are paid directly to LawBits at the time of purchase. Pricing is clearly displayed before checkout.

Refund Policy: If your documents have not yet been generated, you may request a full refund, no questions asked. Once your documents have been generated and delivered, the fee is non-refundable, because the software service has been provided. To request a refund, contact support@lawbits.co.

9. Intellectual Property

All service materials, including the software, document templates, educational content, and preparation frameworks used in connection with LawBits services, are owned by LawBits or its licensors. You may not reproduce, distribute, or create derivative works without written permission.

10. Limitation of Liability

LawBits is not liable for any indirect, incidental, or consequential damages arising from your use of our Services. Our total liability to you shall not exceed the amount you paid LawBits for your plan. LawBits is not responsible for the services of FreedomCounsel or any other attorney you separately engage.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Services shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration shall take place in Texas. You waive your right to a jury trial.

These Terms govern disputes relating to the LawBits software service only. Any dispute regarding an attorney consultation you separately engage with FreedomCounsel or any other attorney is governed by your engagement agreement with that attorney, not by these Terms.
